Tairex AI Hospital User Service Agreement

Welcome to Tairex AI Hospital!

【Agreement Description】

This Agreement is a legally binding agreement between you and Wuxi Tairex Technology Co., Ltd. (hereinafter referred to as “Tairex” or “we”) regarding your use of the Tairex AI Hospital APP and related services.

【Careful Reading】

Before clicking to agree to this Agreement during the registration process, you should carefully read this Agreement. Please ensure that you read and fully understand all clauses, especially those regarding limitation or exemption of liability, applicable law, and dispute resolution (usually indicated in bold or underlined text). If you are under 18 years of age, or otherwise have limited civil capacity, please read this Agreement together with your legal guardian.

【Special Risk Notice】

Before using this service, you must fully understand and agree to the following core risk terms:

  1. Non-Medical Diagnosis:The services provided on this platform, including AI doctors, intelligent consultations, and report interpretation, are based on large language models and related algorithm technologies and are intended for research validation and health consultation purposes only. This platform does not hold a medical practice license, and the output content is provided solely for health consultation and reference purposes. It does not constitute medical diagnosis, treatment plans, prescriptions, or medical advice in any legal sense. These services cannot and should not replace professional face-to-face consultation, diagnosis, or treatment provided by licensed physicians or medical institutions. Final medical opinions should be issued by a qualified doctor.

  2. Emergency Situation DisclaimerThis platform does not provide emergency medical services and does not have the qualifications to do so. If you are experiencing a medical emergency or life-threatening condition, you should immediately seek public emergency medical services (such as dialing 120) or go to the nearest hospital. If you rely solely on the information provided by this platform and delay seeking medical treatment, you shall bear the resulting consequences.

【Special Notice for International AI Doctor Services】

Regarding the “International AI Doctor” services provided by the platform, you acknowledge that the knowledge base and medical logic of such AI doctors may be based on medical guidelines or clinical pathways outside mainland China (such as the U.S. NCCN Guidelines).

Therefore, the recommended examinations, treatments, or medications may:

  1. Not conform to the clinical diagnosis and treatment standards of mainland China;
  2. Involve drugs or medical devices that have not yet been approved for marketing in mainland China.

Such recommendations are for cross-national medical research comparison and reference only and must not be directly applied to clinical medical practice within China.

【Public Beta Special Section】

Considering that this service is currently in the public beta phase, to protect your rights, please carefully read and agree to the following special provisions during the beta period. This chapter shall take precedence over other clauses of this agreement. In case of inconsistency, the provisions of this chapter shall prevail.

  1. Beta Nature and Risk Disclosure: You acknowledge and agree that the currently provided “Tairex AI Hospital” is a beta version. The primary purpose of this version is to test system stability, validate algorithms, and collect user feedback, rather than formal commercial operation. Therefore, the service may have known or unknown program errors, functional defects, service interruptions, model hallucinations, or security vulnerabilities.

  2. No Guarantee Commitment: During the beta period, we provide the service “as-is” and “as available.” We do not make any express or implied warranties regarding:

(1) The service will meet all your needs or specific purposes;

(2) The service will be uninterrupted, timely, secure, or error-free;

(3) AI doctor responses will be absolutely accurate, reliable, or non-misleading;

(4) Any software defects will be corrected.

  1. Data Deletion and Reset Risks: We may, according to testing needs (e.g., version iteration, underlying architecture adjustments), perform server maintenance, upgrades, or data resets at any time. You explicitly agree that during the beta period or after its conclusion, your account information, health records, consultation history, uploaded images, and other data may be permanently deleted or cleared, and cannot be migrated to future official versions. Please back up important data yourself. We are not responsible for any losses caused by data deletion.

  2. Liability Limitation: Due to inherent technical defects, instability of the beta version, or network attacks (e.g., DDoS) causing you any direct or indirect loss (including but not limited to data loss, device failure, or delayed diagnosis), we shall not bear any compensation responsibility. If applicable law requires us to assume liability, the total compensation shall be limited to RMB 100.

【Signing Confirmation】

By filling in your information, reading and agreeing to this agreement, and completing all registration procedures as prompted on the registration page, you confirm that you have fully read, understood, and accepted all contents of this agreement (including the special beta chapter above) and have reached an agreement with Tairex to become a user of Tairex AI Hospital. Your registration action is deemed as unconditional acceptance and compliance with all the terms of this agreement. If you do not agree with this agreement or any of its terms, you should immediately stop the registration process.

【Definitions】

The following definitions apply in this agreement:

  1. Tairex AI Hospital APP: refers to our developed and operated mobile Internet hospital service platform. This application is a medical and medical research simulation system, not an Internet hospital practicing institution.

  2. Tairex AI Hospital APP Service Provider: refers to Wuxi Tairex Technology Co., Ltd. (hereinafter “we”).

  3. User: refers to a person who has registered and logged in to use our products and services, referred to as “you” or “user” in the agreement.

I. Account Management

  1. Before using this service, you should register an account through the page via mobile number or third-party account, fill in true, accurate, legal, and valid information as required, and confirm agreement to this agreement and other related rules and policies. If the submitted materials or information are inaccurate, untrue, irregular, or the company reasonably suspects it is incorrect, untrue, or illegal, we have the right to refuse to provide relevant functions, and you may be unable to use some or all features. Your account is your credential for logging in and using the service, non-transferable, non-giftable, and non-inheritable. For us, your account and password are the sole basis for verifying your identity. Once the correct account is used, whoever logs in is deemed authorized by you.

  2. When registering and using the account, you must commit and guarantee:

(1) You bear full responsibility for the authenticity, legality, and validity of registration information, timely update it, and not impersonate others;

(2) Properly keep account and password and bear legal responsibility for all activities under the account;

(3) Not maliciously register accounts, including frequent or bulk registration;

(4) For the accuracy of health data and effectiveness of AI analysis, you shall not transfer, lend, rent, provide for others, or use accounts in multi-person mixing ways. Any data confusion or analysis deviation caused by account sharing shall be borne by you.

  1. In case of account loss, forgotten password, or verification code leakage, you can appeal to recover. You should properly keep your account, password, and verification code. After use, you should log out safely. Users shall bear responsibility for any losses caused by account or password leakage. Users discovering unauthorized use of their account should immediately notify us, and we will cooperate and handle it.

  2. Upon user request to delete the account, after review and approval, the account will be deleted and the user relationship with us terminated. However, we may still:

(1) Retain registration data and past activity records according to laws;

(2) Exercise rights for any illegal or agreement-violating behavior before account deletion.

II. Confirmation and Acceptance of Agreement

  1. We specially remind you that the agreement content includes the main agreement, legal statements, privacy policy, and all rules, standards, notices, and announcements we have issued or may issue in the future (collectively “Rules”). Legal statements, privacy policies, and all rules are integral parts of this agreement and have equal legal effect. You agree to all registration agreement terms and complete registration to become a formal user.

  2. Clicking login is deemed confirmation that you have the rights and ability to enjoy our services and can independently bear legal responsibility.

  3. Users under 14 may only use the APP under parental or guardian supervision.

  4. We reserve the right to refuse service, close accounts, delete or edit content, or cancel orders within the scope permitted by PRC law.

  5. You must have legally qualified third-party Internet access service and bear all costs for equipment, telephone, network, etc.

  6. You shall provide complete, true, accurate personal information for real-name authentication. If any information is false, outdated, or incomplete, or we reasonably suspect so, we may suspend or terminate your account. You may contact us to correct information.

  7. Services will not be provided to temporarily suspended or permanently terminated users.

III. Rights and Responsibilities of Tairex AI Hospital

  1. Assist legal communication between doctors and patients, and provide necessary technical help;

  2. Maintain network platform operation and improve technology;

  3. As a communication platform, not responsible for the source or correctness of user-posted information; AI output is aimed to improve accuracy, but final diagnosis relies on offline doctors;

  4. Handle improper user behavior or terminate service without consent;

  5. May retain, delete, or stop providing services based on user data, notifications, or illegal behavior;

  6. Have the right to review registration data and activities and issue correction notices;

  7. Publicly disclose violations when confirmed by law or sufficient facts.

IV. Rights and Responsibilities of Users

  1. Users must follow laws, agreement, fairness, and honesty, and not infringe others’ rights or disrupt platform order.

  2. Users must not input or output illegal information including content against the constitution, threatening national security, endangering others, promoting extremism, pornographic content, harassment, etc.

  3. We may monitor user behavior for compliance; users must not attempt to bypass such mechanisms.

  4. Users must not interfere with or attack the system, network, model, or other components, including illegal access, virus propagation, data theft, etc.

  5. Users must not use the system for illegal, harmful, unethical, or commercial infringing purposes.

  6. Outbound transmission of technical data must comply with Chinese laws.

  7. Noncompliance can result in immediate service suspension; users are legally responsible for their online behavior.

  8. Users authorize us to use patient-related data to provide services.

  9. Users understand that sensitive biometric data may be collected and must be genuine.

V. Breach Compensation

Users shall compensate for any damages caused to the hospital, doctors, us, or third parties due to legal or agreement violations, including attorney fees.

VI. User Account, Password, and Security

  1. Logging in successfully constitutes legal user status; user is responsible for account security.

  2. We are not liable for losses due to hacking or negligence.

VII. Service Suspension, Change, and Interruption

  1. We may change, suspend, or terminate service.

  2. Service interruptions for maintenance require no compensation but notice will be given.

  3. Beta instability, cloud resource limits, network issues, or attacks may cause delays, interruptions, or loss; we bear no compensation.

  4. Service may be interrupted or terminated without liability for violations, false info, or other improper actions.

VIII. Service Termination

Users may stop using services or request termination; we are not liable for remaining services or account info.

IX. Personal Information Protection

We will take security measures to protect personal information as required by law; see our Privacy Policy.

X. Intellectual Property

  1. Tairex owns all rights (software, code, models, UI, text, etc.) except rights granted to users by law or agreement. We may use anonymized user data to train models; IP belongs to Tairex.

  2. Do not use trademarks, logos, or AI doctor/nurse images without permission.

  3. User-patient interactions and content may not be modified, reposted, or distributed; violators bear legal responsibility.

  4. Do not use content for commercial purposes without online authorization.

  5. User behavior must comply with Chinese data laws; violations result in termination and liability.

XI. Special Authorization

  1. If a user breaks a promise confirmed by authority, we may restrict or terminate service.

  2. We may notify third parties or platforms to restrict your services.

  3. You authorize us to use information generated during registration and service use and send communications.

XII. Disclaimer

  1. Users assume risk for mobile network services.

  2. No guarantee services will fully meet requirements or be uninterrupted.

  3. Medical institution limitations may affect service.

  4. Services and content are provided “as-is”; no express or implied guarantees except as required by PRC law.

  5. We do not guarantee virus-free or loss-free services.

  6. No liability for force majeure events.

  7. AI output may contain errors; final decisions must be made by professionals. Users assume all consequences.

  8. AI output is probabilistic and may vary for different users.

  9. Medical Imaging and Report Interpretation: AI analysis is limited by image quality and does not replace clinical assessment. Final clinical reports must be followed.

  10. AI-generated content will include synthetic identification; users must not remove or tamper with it.

XIII. Limitation of Liability

  1. Services provided at the best possible level; we are not liable for events beyond control.
  2. We are not liable for any direct, indirect, incidental, special, or consequential damages from network use except as required by law.
  3. Medical responsibility from doctor behavior is borne by the medical institution; the client is only a communication platform.

XIV. Agreement Modification

We may modify terms; updates are effective upon publication. Users must read the latest agreement and discontinue service if disagreeing.

XV. Notices

All notifications may be delivered via announcement, email, SMS, or mail; considered delivered upon sending.

XVI. Governing Law and Jurisdiction

  1. The agreement is governed by PRC law (excluding conflict of law rules).

  2. Disputes should first be resolved amicably; if not, litigation may be filed in the court where Wuxi Tairex Technology Co., Ltd. is located.

XVII. Miscellaneous

  1. This agreement constitutes the complete agreement regarding services.

  2. If any clause is invalid, the rest remain effective.

  3. Headings are for convenience and ignored in interpretation.

  4. We may revise terms according to law and business development; continued use implies acceptance. Contact: tairex@tairex.cn.
